These terms apply when you use nilocards.com, create an account, buy a spot in a break, or buy a card from our shop. Nilo Cards is a hockey card business based in Montréal, Québec. By creating an account or placing an order, you agree to these terms.
You need an account to buy spots or cards. You must be at least 18 years old, or the age of majority where you live, to create one and buy anything.
Keep your password private. You're responsible for orders placed from your account. Keep your name and shipping address up to date: every order ships to the address saved on your account at the time you check out.
A break is a group opening of one or more sealed boxes of hockey cards. In a break, you're given one or more NHL teams. You receive every card from your teams that comes out of the product opened in that break, whether that's several cards, one card, or none, except base cards, which aren't shipped.
Spot sales close at the break's start time shown on the break page, or once every spot has been bought. We then open the product live on stream. The contents of sealed product are random and are not known to us in advance: we don't guarantee any particular card, hit, number of cards, or value for any spot. Only buy what you're comfortable spending.
Cards are assigned as follows:
We handle packs and cards with care. If a card has a manufacturing defect, you'll need to contact the manufacturer directly for compensation.
Nilo Cards reserves the right to postpone, move or cancel a break for any reason (for example, if not every spot in a break sells).
If a break can't go ahead (for example, the product is damaged or doesn't arrive), we'll reschedule it and tell you by email. If we cancel it outright, every spot in it is refunded in full to the original payment method.
The detailed break rules are posted at https://nilocards.com/how-breaks-work. Nilo Cards may change them at any time, without notice: it's up to you to read them before each break, and by buying a spot you're deemed to have accepted them.
All prices are in Canadian dollars (CAD) and are before tax. Spot prices are flat, first come first served — there's no bidding. Shop cards marked "Price on Request" aren't for sale online; contact us for a quote.
Sales tax is added at checkout based on where your order ships: GST and QST for Québec, HST for Ontario and the Atlantic provinces, GST for the rest of Canada. Orders shipping outside Canada aren't charged Canadian sales tax but may be subject to import duties or taxes in the destination country, which are the buyer's responsibility.
Payment is handled by Stripe. A spot or card is held for you for a few minutes while you pay; if you don't complete payment in that time, it's released and you aren't charged. Your order is confirmed when payment succeeds and you receive our confirmation email. If you can't pay by card, contact us: we can reserve spots for your account and invoice you to pay by Interac e-Transfer. Those spots are confirmed when we receive the transfer and send your receipt, and we may cancel the reservation if the transfer doesn't arrive.
Promo codes can't be exchanged for cash, can't be combined unless we say so, and may be withdrawn or limited in number of uses.
Because every break is a live, one-time opening of random sealed product, all sales are final. Once paid, spots, shop cards and tracked-shipping upgrades are not refundable, exchangeable or transferable, including when the cards you receive are fewer or worth less than you hoped.
This doesn't limit the rights you have under Québec's Consumer Protection Act or other law that can't be waived. In particular, we will refund or make it right if:
Contact us within 14 days of receiving your order about any of these. Refunds go back to the original payment method.
We ship within Canada only, to the address on your account when you checked out.
Standard shipping is free. After a break, we let you know which cards you won, if any (in your account or by email), then ship them by regular mail, without tracking. Base cards aren't shipped.
If you'd like a tracking number, let us know before 8:30 a.m. on the business day after the break, by going to your account and paying $20 CAD plus tax. We'll email you the tracking number when the cards are mailed. Otherwise, your cards ship by standard mail.
Nilo Cards isn't responsible for cards or merchandise that were mailed but not received, and doesn't guarantee Canada Post delivery times. We aren't responsible for merchandise stolen, lost or damaged in the mail. We strongly recommend tracked shipping for high-value cards; for tracked shipments, we'll work with the carrier on any claim.
Please check your address before every purchase: we can't redirect a package once it's mailed, and we aren't responsible for orders shipped to an incorrect address you provided.
Breaks are streamed live (on YouTube, embedded on our site, and on our social media) and may be recorded and replayed. Our streams may show your first name, full name or username and the team you bought or were assigned. Tell us before a break if you'd rather not be named on stream.
The text, photos, videos and design of nilocards.com belong to Nilo Cards. Team and player names are used only to describe the cards; Nilo Cards isn't affiliated with or endorsed by the NHL, the NHLPA, any team, or any card manufacturer.
Don't misuse the site: no automated buying, attempting to interfere with other buyers' checkouts, fraudulent payments or chargebacks, or abusive behaviour toward us or other collectors on our streams. We may cancel orders (with a refund) and close accounts that break these rules.
To the extent permitted by law, our total liability for any order is limited to the amount you paid for it. We aren't liable for indirect losses, such as the resale value you expected from a card. Nothing in these terms excludes liability that can't be excluded under Québec law.
We may update these terms. The version posted when you place an order applies to that order. We'll post any update here with a new date, and email you about material changes before they apply to you.
These terms are governed by the laws of Québec and the federal laws of Canada that apply there. These terms are available in English and French; both versions are equally valid.
